Last updated: 2026-06-27
These Terms of Service ("Terms") govern your access to and use of Octopus, including our website, web application, and related services (collectively, the "Service"). By creating an account, clicking acceptance, or using the Service, you agree to these Terms.
1. Who We Are
"Octopus", "we", "us", and "our" refer to INSALABS, a Société à Responsabilité Limitée (SARL) incorporated in Tunisia (RNE: 1986144C), with registered address at Immeuble Tamayouz, Bureau A1, Centre Urbain Nord, 1082 El Menzah, Tunis, Tunisia. For legal notices, contact: contact@octopus-agent.com.
2. Eligibility and Account Registration
- You must be at least 18 years old (or the age of majority in your jurisdiction).
- You must provide accurate, complete, and current account information.
- You are responsible for safeguarding your credentials and all activity under your account.
- You must promptly notify us of unauthorized use of your account.
3. Description of the Service
Octopus helps users organize job-search data and automate parts of the application workflow, including AI-assisted resume and cover-letter drafting, PDF generation, and communication support. The Service is provided for informational and productivity purposes and does not guarantee any job, interview, visa, or employment outcome.
4. User Content and Permissions
You may upload or submit text, files, and other content, including resumes, cover letters, job descriptions, and profile details ("User Content").
- You retain ownership of your User Content.
- You grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display User Content solely to operate, secure, and improve the Service.
- You represent that you have all rights necessary to provide User Content and that it does not infringe third-party rights.
5. AI-Assisted Features
- Some features use third-party AI providers to generate or transform content.
- AI output may be inaccurate, incomplete, or unsuitable for your use case. You are solely responsible for reviewing, editing, and approving all generated content before use or sending.
- You must not use the Service to generate unlawful, deceptive, discriminatory, or rights-violating content.
6. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, abusive, or harmful activity.
- Upload malware, attempt unauthorized access, or disrupt platform integrity or availability.
- Scrape, reverse engineer, or bypass technical protections except where legally permitted.
- Violate applicable employment, anti-discrimination, consumer, or data-protection laws when using outputs.
- Use another person's account or impersonate any person or entity.
7. Credits, Purchases, and Fees
- Octopus is prepaid and pay-as-you-go: you buy credits and spend one credit per application submitted. There is no subscription and no recurring charge.
- Credit prices and any free credits are shown in-product or on our pricing page.
- Credits never expire and remain in your balance until used.
- If an application fails to be submitted, the credit spent on it is automatically returned to your balance.
- Payments are processed by Flouci (Kaoun SARL), an authorized payment facilitator licensed by the Banque Centrale de Tunisie. We do not store full payment card details.
- Refunds are handled per our Refund Policy and applicable Tunisian law.
8. Intellectual Property
The Service, including software, design, trademarks, and non-user content, is owned by or licensed to Octopus and protected by intellectual property laws. Except as expressly permitted, you may not copy, distribute, modify, or create derivative works from the Service.
9. Third-Party Services
The Service may integrate with third-party providers (including AI providers, email delivery, file storage, and payment processors). Your use of such integrations may be subject to those providers' terms and policies. We are not responsible for third-party services outside our control.
10. Suspension and Termination
- We may suspend or terminate access if you violate these Terms or where required for security or legal reasons.
- You may stop using the Service at any time.
- On termination, provisions that by nature should survive (including payment obligations, disclaimers, liability limits, and dispute terms) remain in effect.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
12. Limitation of Liability
To the maximum extent permitted by law, Octopus is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Our aggregate liability arising from or related to the Service will not exceed the total fees paid by you for the Service in the twelve (12) months preceding the event giving rise to liability. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Octopus and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by Tunisian law, including Law n°2000-83 of 9 August 2000 on electronic exchanges and commerce. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent Tunisian courts.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Material changes may also be communicated in-product or by email. Continued use after changes become effective means you accept the updated Terms.
